Agent 99
I have my sister Nancy to thank for pointing out this fellow sitting on his front porch. If we are lucky she will pick up a camera and amaze us with how she sees the world.
I feel a bit like a spy when I capture the image of someone who is not aware that I am photographing him or her. To ask permission is not always ideal because the moment would be lost. And then there's my timidity that does not allow me to ask permission after the fact. Oh yes, and what if they said no? Do I want to give up the photo? Of course not. Where do I draw the line between the subject's privacy and my right to snap whomever I choose? If I were a poet and rather than capturing my subject with a camera I placed him or her on paper would that be OK? Probably - but then, alas, who reads poetry?

Yes, but it is terribly hard to rhyme photographs.
Actually I'm working on a project - with Mike 'cause he's the poet - that will use photographs as the main ingredient so to speak. If he can make it rhyme than, as they say, that'll be something!
It truly is an amazing photo. And I do agree with you - what are the boundries? I'm thinking that if you were to try to make a profit off it then perhaps permission may be needed. It is not as if you are using it for personal gain - growth perhaps - but not gain. And besides, not your fault you couldn't hold the camera at the right position and got him instead of Mo & Me !! :-)
